Mobile Internet Service Agreement
This Mobile Internet Service Agreement (“Agreement”) is entered into by and between HitchStream, LLC (“Provider”) and (“Customer”) for the provision of mobile internet services during the Customer’s event at on . By signing this Agreement, the Customer agrees to the following terms and conditions:
1. Service Description
1.1. Provider will supply a mobile internet connection consisting of a combination of WiFi, cellular, and/or satellite internet sources, as well as access points for use by Customer and event attendees.
1.2. The service is provided on a “best effort” basis, and Provider does not guarantee specific speeds, uninterrupted connectivity, or performance.
2. Fees and Payment
2.1. The flat rate for the service is $500 per day, due in full to reserve service date.
2.2. Payment confirms the reservation of the service and acceptance of this Agreement.
3. Setup and Testing
3.1. Provider will set up and test the equipment at the event venue prior to the event.
3.2. Customer must ensure reasonable access to the venue for setup and testing at least 3 hours before the event.
3.3. Customer acknowledges that local terrain, weather, and other factors may impact service performance.
4. Equipment Loss/Damage
4.1. The Customer is responsible for ensuring the safety and security of all equipment provided by the Provider during the rental period.
4.2. The Customer agrees to reimburse Provider for the full replacement cost of any equipment that is lost, stolen, or damaged while in the Customer’s possession or during the event.
4.3. The Customer must report any damage or equipment malfunctions immediately to the Provider.
5. Limitations of Liability
5.1. The service is provided as-is. Provider is not liable for slow speeds, interruptions, or outages caused by third-party internet service providers or unforeseen circumstances such as weather or infrastructure failures.
5.2. Provider is not responsible for any loss or damages resulting from the use or inability to use the internet connection, including but not limited to business disruptions, streaming interruptions, or data loss.
5.3. Provider is not responsible for how the internet connection is used by the Customer or their guests, including but not limited to illegal activities, data breaches, or other misuse.
6. Customer Responsibilities
6.1. The Customer is responsible for monitoring and ensuring proper use of the internet connection by all event attendees.
6.2. The Customer agrees to indemnify and hold Provider and the event venue harmless from any claims, damages, or legal actions resulting from improper or illegal use of the internet connection by the Customer or their guests.
7. Force Majeure
Provider will not be held liable for failure to provide services due to events beyond its reasonable control, including but not limited to natural disasters, equipment failure, service interruptions from third-party providers, or government actions.
8. Cancellation and Refund Policy
8.1. Cancellations must be made in writing no later than 14 days before the event to receive a full refund.
8.2. Cancellations made less than 14 days before the event are non-refundable.
9. Governing Law
This Agreement is governed by the laws of the state in which the event takes place.
10. Entire Agreement
This Agreement constitutes the entire understanding between the Provider and Customer concerning the mobile internet service. Any modifications or amendments must be in writing and signed by both parties.
